This Privacy Policy describes how Avtar ("we," "us," or "our") collects, uses, processes, stores, and shares your information when you use our services provided by Avtar Group Inc. ("Avtar," "we," "us," or "our"), including our website (https://avtargroup.ai/) (the “Site”), our AI-powered assistant platform, API, web interface, mobile applications (the “Avtar App”), and cloud infrastructure (collectively, the "Service"). We are committed to protecting your privacy and handling your data transparently and in compliance with applicable data protection laws, the California Consumer Privacy Act (CCPA), where relevant.
This Privacy Policy details the types of personal data we collect, the purposes for which they are collected, and how they are used. Please read this Privacy Policy carefully and ensure that you understand it. By using our Service, you agree to this Privacy Policy and our collection, use, and disclosure of your information as described in this Privacy Policy. If you disagree with this Privacy Policy, you must stop using our Service immediately. We refer interchangeably to “personal information” and “personal data,” which, depending on the jurisdiction, means the data or information based on which a person can be identified.
1. Introduction & About Us
Avtar is an innovative company focused on providing intelligent AI assistant solutions designed for (but not limited to) the following purposes: enhancing productivity, providing information, and automating tasks. This Privacy Policy explains our practices regarding the information we collect to operate, maintain, and improve our Service.
When we refer to “you” and “your” it means you, the person using the Service. We refer interchangeably to “personal information” and “personal data,” which, depending on the jurisdiction, means the data or information based on which a person can be identified.
2. Information We Collect
We collect various types of information to provide and improve our Services, which may include personal data. The types of information we collect depend on how you interact with our Services.
2.1 Information You Provide Directly to Us:
- Account Information: When you create an account, we may collect your name, email address, username, password, and any other information you choose to provide (e.g., date of birth, profile picture).
- User Input / Prompts & Outputs: When you use our Service, we collect personal information that is included in text, voice, images, videos, files, or any other content you input into the Avtar App ("Inputs") and the responses or content generated by the Avtar App based on your Inputs ("Outputs"). Collectively, your “Inputs” and “Outputs” are referred to herein as your “Content.” As described below, we may use the Input that you provide us to improve our services, for example, to train and enhance the models that power our Services. Some of the features of the Services require us to process parts of faces within a video or photo, and this may include face imagery and process voice information. The information we use for this process is used to create and personalize Avtars. See our Biometric Information Privacy Notice and Consent for further information about how we process information to create Avtars.
- Feedback & Communications: If you contact us for support, send us feedback, or participate in surveys, we collect the content of your communications and your contact information.
2.2 Information Collected Automatically (from your device and usage):
- Device Information: We collect information about the device you use to access the App, including device model, operating system, unique device identifiers, IP address, mobile network information, and system language.
- Usage Data: We collect information about your interactions with the Avtar App, such as the features you use, the time and date of your activity, the duration of your sessions, crash reports, and performance logs. This helps us understand how the Avtar App is used and identify areas for improvement.
- Log Data: Our servers automatically record information that your browser sends whenever you visit the Avtar App. This may include your IP address, browser type, app version, and other statistics.
3. How We Use Your Information
We use the information we collect for various purposes, based on legal bases such as contract performance, legitimate interests, your consent, or legal obligations.
3.1 To Provide and Maintain the Services, including the Avtar App:
- To provide and manage your account and access to and use of our Service.
- To operate, maintain, and provide the features and functionality of the Avtar App.
- To process your Inputs and generate relevant Outputs.
- To personalize your experience and deliver content tailored to your interests.
- To store your Content, including conversation history for easy access and continuation (unless you choose to delete it via the self-deletion settings in the Avtar App).
- Marketing: Your personal data will not be used or sold for any external marketing purpose, including targeted ads. See Section titled “For Communication and Support” for more information regarding internal marketing communications.
3.2 For Research and Development / Improve Our Models:
- To understand how users interact with the Avtar App and identify areas for improvement.
- To improve the accuracy, performance, and capabilities of the models that power our Service, including the Avtar APP (“Our AI models”). This may involve using anonymized and/or aggregated user Input/Output data for model training and refinement. We take measures to de-identify data used for model improvement to minimize privacy risks. Your Content is NOT used to train or improve public models unless explicitly stated otherwise or with your explicit consent. Our AI models do NOT learn from your individual usage in a way that directly associates with your identity for public model training.
- To develop new features and services.
3.3 For Communication and Support:
- To respond to your inquiries, provide customer support, and address your requests.
- To send you service-related notifications, updates, and administrative messages.
- With your consent, to send you marketing communications about our products and services. You can unsubscribe from emails at any time by using the unsubscribe function in the email communication to you.
3.4 For Security and Compliance:
- To detect, prevent, and address technical issues, fraud, abuse, and other security vulnerabilities.
- To ensure compliance with our Terms of Use and other policies.
- To comply with legal obligations, respond to lawful requests, and protect our rights and property.
4. How We Share Your Information
We only disclose or share your personal information as described in Privacy Policy. We will never sell your data. We may share your information with the following categories of third parties in limited circumstances:
- Service Providers: We engage third-party companies and individuals to facilitate our Services, including the Avtar App, for example (but not limited to) hosting, analytics, customer support, data storage, payment processing, and use of your image and voice to create your personalized Avtar Personal AI Assistant (defined in the Terms of Use). These service providers have access to your personal information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
- Affiliates: We may share information with our current and future affiliated companies, subject to this Privacy Policy.
- Legal Compliance and Protection: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency request) or to otherwise comply with applicable law. We may also disclose your information if we believe it is necessary to protect our rights, property, or safety, or the rights, property, or safety of others, including to prevent harm or fraud.
- Business Transfers: In connection with or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company, your personal information may be disclosed to the acquiring entity, subject to obligations of confidentiality. Additionally, personal information provided by users will, where it is relevant to any part of our business so transferred, be transferred along with that part, and the new owner or newly controlled party will, under the terms of this Privacy Policy, be permitted to use the information for the purposes for which it was originally collected by us.
- With Your Consent: We may share your information with third parties when we have your explicit consent to do so.
We may also compile statistics about the use of our Site, including data on traffic, usage patterns, user numbers, sales, and other information. All such data will be anonymized and will not include any personally identifying information. We may occasionally share such data with third parties, such as prospective investors, affiliates, partners, and advertisers. Data will only be shared and used within the bounds of the law.
5. Data Security
We implement commercially reasonable technical, administrative, and organizational measures designed to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. These measures include:
- Encryption: Data is encrypted both at rest (when stored) and in transit (when being sent over networks, using technologies like SSL/TLS).
- Access Controls: Strict access controls and authentication mechanisms are in place to ensure that only authorized personnel can access user data on a need-to-know basis. Multi-factor authentication (MFA) is required for all administrative access to our systems.
- Regular Audits: We conduct regular security audits and vulnerability assessments to identify and address potential weaknesses.
- Secure Infrastructure: Our infrastructure is hosted by reputable cloud providers that implement industry-leading security practices.
However, please be aware that no security measure or method of data transmission over the internet is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You are also responsible for protecting your account credentials, limiting access to your devices, and signing out of the App when not in use.
6. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.
The criteria used to determine retention periods include:
- The nature and sensitivity of personal data.
- The purposes for which we process your personal data and how long we need to fulfill those purposes.
- Legal, regulatory, or contractual requirements.
- The necessity for dispute resolution or enforcing our agreements.
When your personal information is no longer needed, we will securely delete or anonymize it in a manner that prevents its reconstruction or identification.

- Note for AI Outputs: While we strive for accuracy, our AI Models can sometimes produce factually inaccurate information ("hallucinations"). If an Output contains factually inaccurate personal information relating to you, you can submit a correction request. We will make reasonable efforts to correct this information in our records and outputs where feasible, but due to the technical complexity of AI Models, it may not be possible to completely "remove" or "correct" specific factual inaccuracies from the underlying trained model weights.
- Right to Delete / Right to Be Forgotten: You have the right to request the deletion of your personal information.
- Right to Restrict Processing: You have the right to request that we restrict the processing of your personal information under certain conditions.
- Right to Object to Processing: You have the right to object to our processing of your personal information, including the right to object (i.e., opt out) to your information being used to train our AI Models. You also have the right to object to marketing at any time by using the unsubscribe/opt-out function displayed in our communications to you.
- Right to Data Portability: You have the right to request a copy of your personal information in a structured, commonly used, and machine-readable format, and to transmit that data to another controller.
- Right to Withdraw Consent: Where we rely on your consent to process your personal information, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.
- Right to Appeal: Depending on your location, you may have the right to appeal decisions we make regarding your privacy requests.
How to Exercise Your Rights: To exercise any of these rights, please contact us using the "Contact Us" details provided at the end of this Privacy Policy. We may need to verify your identity before fulfilling your request. We will not discriminate against you for exercising these rights.
8. Children's Privacy
Our Avtar App and Services are not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18 without verifiable parental consent, we will take steps to remove that information from our servers. If you believe we might have any information from or about a child under 18, please contact us immediately at abuse@Avtargroup.ai.
9. Cookies and Other Tracking Technologies.
Avtar does not use cookies, beacons, pixels, local storage or any other tracking technologies on our website or as part of our Services. We do not track your online activities over time or across third-party websites.
10. Additional U.S. State Disclosures
This section provides additional information to residents of California, Colorado or other U.S. states that have passed a law similar to the California Consumer Privacy Act (“CCPA”). For purposes of this section, “personal information” also includes “sensitive personal information” as those terms are defined under the CCPA.

We only use and disclose sensitive personal information for the purposes specified in the CCPA or otherwise with your consent.
We do not “sell” or “share” (as those terms are defined in the CCPA) personal information, nor have we done so in the preceding 12 months. Further, we do not have actual knowledge that we sell or share personal information about California residents under 16 years of age.
Shine the Light. If you are a California resident, this section applies to you. The California Shine the Light law (Cal. Civ Code §1798.83) permits residents of California to request certain details about how their information is shared with third parties for the third parties’ direct marketing purposes. If you are a California resident and would like to make such a request, please contact us at privacy@Avtargroup.ai , include “CA Shine the Light” in the subject line of your email.
No Financial Incentive. We do not offer any financial incentives or price or service differences in an attempt to influence a Consumer’s decision whether or not to exercise a right afforded to the Consumer under California law.
We will not discriminate against you for exercising any of your Applicable State privacy rights.
11. Changes to This Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top. We will also inform you via email and/or a prominent notice on our App prior to the change becoming effective. We encourage you to review this Privacy Policy periodically for any changes.
