AvTAR Group Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your access to and use of the services provided by Avtar ("we," "us," or "our"), including our AI-powered personal assistant platform, web interface, mobile applications (collectively, the “Avtar App”), APIs, and related resources (collectively, the "Service"). By using the Service, you ("User" or "You") agree to comply with this Policy and our Terms of Use.

1. General Principles

You are responsible for your use of the Service, and you represent and warrant that you will use the Service, including the Avtar App lawfully, ethically, and respectfully and will avoid any activity that could harm, interfere with, or disrupt our services or other users.

2. Prohibited Uses

You agree not to use the Service for any of the following purposes:

• Illegal Activity: Engaging in any illegal, fraudulent, or malicious activities. This includes, but is not limited to, violating any applicable laws or regulations or engaging in criminal activity.
• Harmful, Offensive, or Inappropriate Content: Creating, transmitting, or displaying content that is abusive, harassing, threatening, defamatory, obscene, pornographic, sexual, hateful, discriminatory, or otherwise objectionable.
• Infringement of Rights: Infringing upon the intellectual property rights (including copyrights, trademarks, and patents) of others. This includes unauthorized use, distribution, or modification of copyrighted material.
• Malware and Security Risks: Introducing viruses, malware, trojans, worms, or other harmful code into the app. Attempting to circumvent our security measures or gain unauthorized access.
• Disruption of Services: Interfering with the proper functioning of the app, including denial-of-service attacks, spamming, or excessive usage that impairs performance for other users.
• Automated Abuse: Using bots, scripts, or other automated methods to access or use the app in a manner that violates this Policy or our Terms of Use.
• Data Harvesting & Scraping: Collecting, harvesting, or scraping data from the app without our express written consent.
• Circumvention: Attempting to bypass any technical measures we implement to enforce this Policy or protect the app.

· Confidential or Sensitive Data. Do not share confidential or sensitive information with the Service that you would not want to be potentially exposed.

3. AI Avtar Creation and Use; Additional AI-Specific Restrictions

The Service allows you to create a personalized AI avatar (we call it “Avtar”) based solely on your own photo image and voice. You may not use the Service to create an Avtar of any other person, whether real, fictional, public, or private, and you may not create Avtars on behalf of any other individual or entity. You retain all ownership rights in the personalized Avtar you create. You are solely responsible for ensuring that your creation, use, or sharing of your Avtar complies with applicable law and does not violate the rights of any third party or these Terms.

To maintain a safe and lawful environment on the Service, you may not use the Service to create, upload, generate, or share any Avtar—or any content used to create an Avtar—that:

• Displays illegal, defamatory, sexually explicit, pornographic, violent, threatening, abusive, inflammatory, harmful, hateful, cruel, insensitive, or deceptive imagery, including through likenesses, symbols, or insignia.
• Depicts or appears to depict individuals under the age of 18, as determined in Company’s sole discretion.
• Depicts any real individual other than yourself, including celebrities, public figures, private individuals, or any person whose likeness, image, voice, or identity is not your own.
• Uses or incorporates copyrighted images or materials without authorization from the rights holder.
• Creates or uses deepfake, synthetic, or manipulated media that depicts any individual other than yourself, or that is intended to mislead, impersonate, deceive, or cause harm.
• Do not upload or share with the Avtar App any confidential information that you would not want to be potentially exposed. 
• Additional AI-Specific Restrictions

Because our Services are powered by AI, the following restrictions are crucial:

• High-Risk Applications: Using the Avtar App for applications where errors could cause serious harm, including medical diagnosis, financial advice, legal advice, or control of critical infrastructure. We are not responsible for decisions made based on AI-generated information in these sensitive areas.

· Data Privacy Prohibitions: Avtar specifically prohibits the following:

o Uploading or sharing with Avtar or in the Service of sensitive information such as regulated health information, sensitive personal identifiers (e.g., social security number or credit card or other financial information), personal data of any persons under the age of 18.

o uploading or sharing with Avtar or in the Service, the personal data of others without their explicit consent.

• Discriminatory or Biased Outputs: Attempting to generate content that is discriminatory, biased, or unfairly targets individuals or groups. While we strive to mitigate bias in our AI models, you are responsible for reviewing the output and ensuring its fairness.
• Automated Decision-Making with Significant Impact: Using the Avtar App to make automated decisions with legal or similarly significant effects on individuals (e.g., loan approvals, employment decisions) without appropriate human review and oversight.
• Prompt Injection & Manipulation: Attempting to manipulate the Avtar App through prompts to generate harmful, unethical, or inappropriate content.
• Bypassing Safety Filters: Intentionally attempting to circumvent our safety filters or content moderation systems.

4. Monitoring & Enforcement

We reserve the right to monitor your use of the Service to ensure compliance with this Policy. Avtar may investigate suspected violations and take appropriate action, including:

• Warning you.
• Suspending or terminating your account.
• Disabling access to any Avtar, or related content, including removing any content that violates this Policy
• Reporting illegal activity to law enforcement.

5. User Responsibility & Indemnification

You are solely responsible for your conduct while using the Service. You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your violation of this Policy.

6. Modifications to this Policy

We may update this Policy from time to time. We will post any changes on our website and notify you of material changes. Your continued use of the app after any changes constitutes your acceptance of the revised Policy.
